Terms of Use

> You must not use the Biyogaz Akademisi platform without reading and accepting this notice. Accessing and using the platform means you accept these Terms of Use unconditionally and without reservation.
1. Parties and Definitions
These Terms of Use constitute an electronic agreement between Biyogaz Akademisi (hereinafter referred to as the "Academy", "Platform", or "we") and any natural or legal person who accesses, registers with, or produces content on the platform (hereinafter referred to as the "User" or "you").
- Service: All web-based content, tools, and services offered through https://biyogazakademisi.com and its subdomains.
- Content: All articles, comments, images, documents, code, metadata, and digital assets published by the Academy or uploaded by the User.
- User content: Comments, applications, biographies, bookmark notes, and any other data produced by the User or transmitted via the Platform.
2. Scope and Nature of the Service
The Academy is an information platform offering academic-quality content publication, free reading, downloading, commenting, and newsletter services in the field of biogas and renewable energy. All or part of the service may be modified, suspended, or terminated at the sole discretion of the Academy without prior notice. The Academy does not provide any guarantee that the service will be uninterrupted, error-free, or fit for a particular purpose.
The academic content published on the Platform is for informational purposes only; it is not a substitute for professional engineering consultancy, legal opinion, financial advice, or investment advice. Always seek the opinion of a qualified expert before any field application. The Academy cannot be held liable for any damages arising from the application of the information in the content.
3. User Account
3.1 Registration and Accuracy
You declare and undertake that the information you provide when creating an account is accurate, current, and complete. All administrative, legal, and criminal liability arising from registration with false, incomplete, or third-party information rests with you.
3.2 Account Security
You are solely responsible for the confidentiality of the username, password, and two-factor authentication information of your account, as well as all transactions performed through your account. If you suspect unauthorized access to your account, you are obliged to notify the Academy immediately; otherwise, you will be held liable for damages arising from delay.
3.3 Account Suspension and Termination
The Academy reserves the right to unilaterally suspend, restrict, or permanently close your account without giving any reason and without prior notice in the following cases:
- Violation of these Terms of Use
- Use contrary to applicable legislation
- Behavior harmful to other users or the Platform
- Fake account, multiple accounts, or bot transactions
- Any behavior contrary to the legitimate interests of the Academy
4. Prohibited Uses
The following behaviors on the Platform are strictly prohibited and, if detected, will result in account closure, initiation of legal proceedings, and demand for legal/criminal responsibility:
- Collecting or downloading content with automated tools (bots, scrapers, crawlers); automated access to non-API endpoints
- Unauthorized access attempts to the Academy's software, servers, database, or infrastructure; searching for or exploiting security vulnerabilities
- Sending queries at an intensity that would degrade service quality (DDoS, brute-force, exceeding rate-limit)
- Uploading content containing copyright infringement, obscenity, harm to personal rights, insult/slander, discrimination, or incitement to violence
- Spreading spam, advertisements, multi-level marketing, affiliate links, crypto promotion
- Impersonating someone else, using a false professional title
- Republishing Academy content on other platforms without permission (without complying with CC BY 4.0 attribution conditions)
- Publishing articles or comments containing academic ethics violations (plagiarism, fake sources, data fabrication)
- Unauthorized use of the Academy's trademark, logo, design, or code
- Harassment, threats, or intimidating behavior toward other users
5. User Content and License Grant
When you upload comments, article applications, biographies, bookmark notes, or any other content to the Platform, you automatically grant the Academy a worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable right of use. This right grants the Academy the following authorities:
- To publish the content on the Platform and related distribution channels
- To copy, store, process, and convert the content according to technical requirements
- To quote the content for promotional, academic reference, or editorial purposes
- To transfer the content to third-party partner systems (e.g., archive services, academic indexes)
Representations and Warranties: You represent and warrant that the content you upload belongs entirely to you, does not infringe the copyright or personal rights of third parties, does not contain confidential/trade secrets, and complies with applicable legislation. In case of detection of the contrary, all legal liability rests with you, and you are obliged to compensate the Academy for any direct/indirect damages (including attorney fees, court costs, third-party indemnification).
6. Intellectual Property Rights
6.1 Academy Content Copyright
Academic articles published on the Platform are offered under the CC BY 4.0 (Attribution 4.0 International) license. This license applies only to published article text, images, and downloadable documents. License terms:
- Attribution is mandatory (author, article title, https://biyogazakademisi.com source address, date of publication)
- Commercial use is permitted
- Derivative works may be produced; however, the CC BY 4.0 license must be preserved in redistribution
6.2 Copyright Outside CC BY 4.0 Scope
The following elements are outside the scope of CC BY 4.0 and are the exclusive property of the Academy; their unauthorized copying, use, or distribution is prohibited:
- Site design, user interface, CSS/JS code, theme files
- Academy name, logo, and all brand elements
- Database structure, schema, category taxonomy
- In-site navigation, tagging system, and metadata architecture
- Editorial publication workflow and methodological documents
- All helper texts displayed in the user interface and i18n content
6.3 Copyright Infringement Notice (Takedown)
If you believe that content on the Platform infringes your copyright, send a notice to kvkk@biyogazakademisi.com containing the following:
- Your identity information as the rights holder
- Description of the original work allegedly infringed and the legal basis of your claim
- URL or location of the infringing content on the Platform
- Statement regarding the accuracy of the notice
7. Links and Third-Party Content
The Platform may contain external DOI links, links to third-party publisher sites, and redirects to external sources for academic reference purposes. The Academy is not responsible for the content, accuracy, security, or policies of these links. Any consequences you may encounter after leaving by clicking on an external link are entirely your responsibility.
8. Disclaimer
The service is offered "as is" and "as available". The Academy does not guarantee any of the following:
- That the service will be uninterrupted, timely, secure, or error-free
- That the content will be complete, accurate, or current
- Suitability for a particular purpose
- That the results you will obtain will meet your expectations
- The continuity of third-party services (ipinfo.io, email providers, server infrastructure)
9. Limitation of Liability
To the maximum extent permitted by applicable law, the Academy's total liability arising from this agreement or the use of the service is limited to direct and foreseeable damages, and in no event shall exceed zero Turkish Lira (0 TRY) (since the service is offered free of charge). The Academy shall not be liable in any case for the following damages:
- Indirect damages
- Loss of profit, loss of revenue, business interruption
- Data loss, loss of reputation
- Moral damages
- Damages arising from third-party claims
- Damages arising from events such as force majeure, war, natural disaster, epidemic, government intervention, internet outage, server failure
10. Indemnification
You are obliged to defend and indemnify the Academy against all claims, lawsuits, penalties, or administrative actions directed against the Academy, its employees, managers, or business partners due to your violation of these Terms of Use, the content you upload, or the way you use the service. This obligation also covers attorney fees, court costs, and reasonable third-party indemnification.
11. Independence and Severability
If any provision of these Terms of Use is invalid, unenforceable, or annulled by a competent court, the other provisions shall continue to be in full force and effect. The invalid provision shall be deemed replaced by a valid provision closest to the original purpose.
12. Changes
The Academy reserves the right to change these Terms of Use at any time, unilaterally and without prior notice. Important changes are published on this page along with the current version date. Continuing to use the Platform after the publication of the changes means that you accept the new terms.
13. Personal Data and Privacy
For details on the processing of your personal data, please review our KVKK Disclosure Notice and Privacy Policy pages. These pages are an integral part of the Terms of Use.
14. Force Majeure
Unforeseen and unpreventable events such as natural disasters, epidemics, war, terrorism, government intervention, server/internet infrastructure failure, third-party service outages (DNS, CDN, email provider) shall be deemed force majeure. The Academy shall not be liable in any way for service disruptions or damages arising from force majeure.
15. Assignment
You cannot transfer your right to use the service, your account, or your rights arising from this agreement to third parties without the prior written consent of the Academy. The Academy, on the other hand, may transfer its rights and obligations to third parties at any time without notice.
16. Applicable Law and Competent Court
These Terms of Use are subject to the laws of the Republic of Türkiye. Istanbul Central (Çağlayan) Courts and Enforcement Offices have exclusive jurisdiction in the resolution of any disputes arising from or related to this agreement.
For natural person users acting in the capacity of consumers, the provisions of Law No. 6502 on Consumer Protection and related legislation are reserved.
